Accruent Academy Terms and Conditions

1. Training included with the Software Purchase

Standard eLearning: Training access will be provided through enrollment keys. The enrollment key allows users to register and automatically receive the included training. The access provided by the enrollment key will end at the end of the software contract.  

2. Training purchased through Statement of Work

1. Virtual Instructor-Led Training: To guarantee the quality of training, the maximum number of attendees per training session is ten. For scheduled training, the minimum number of attendees is four.

Accruent reserves the right to cancel a class if the minimum number of participants has not been confirmed one week before a virtual class. In this situation, all attendees will be automatically moved to the next planned session.

Customers may opt to substitute attendees but must notify Accruent at least one week before class starts.

All training sessions are conducted in English. Training materials are provided in English only, unless otherwise agreed upon and at additional costs.

2. Classroom Training at Customer Location: The maximum class size is ten attendees per Accruent Product Trainer. If the class size is over ten attendees an additional Accruent Product Trainer is required to go onsite at an additional cost, to support the increased class size.

The customer is responsible for organizing a training room with stable internet and providing the Product Trainer with lunch during training days.

All training sessions are conducted in English. Training materials are provided in English only, unless otherwise agreed upon and at additional costs.

Attendees are required to bring a Laptop/PC to the training for which they have administrative rights and a power outlet adaptor suitable for the location of the training.

Travel expenses made by the Accruent Product Trainer will be charged to the Customer at actual cost.

In the event Customer cancels or reschedules any travel with less than 30 days of notice before the scheduled travel date, Customer is responsible for up to 50% of any additional fees associated with rebooking or canceling the arrangements.

In the event Customer cancels or reschedules any travel with less than one week of notice before the scheduled travel date, Customer is responsible for up to 100% of any additional fees associated with rebooking or canceling the arrangements.

3. eLearning file delivery: eLearning file(s) can be delivered in either SCORM 1.2, SCORM 2004 (edition 2, 3, or 4), or TinCan/xAPI format. The source files of standard or custom eLearning courses are not provided.

For custom eLearning, a full functionality test with a sample file will be required before the development of the eLearning content. In the case the test is successful, the development of the custom eLearning file will start. In the case the test is unsuccessful, the project is on hold until the full functionality test can be executed successfully on the customer side.

4. Custom eLearning: A project schedule will be developed in agreement with the Customer. If at any time either party does not meet the deadlines outlined within the project schedule, the project schedule will be revised to accommodate any delays, and a new, mutually agreed upon schedule will be developed in agreement with the Customer.

Customers must complete content reviews and provide feedback within the timeframe agreed in the project schedule. Delays in the review process will cause a delay in the project, releasing Accruent from responsibility to any specified delivery dates. In the case of an impact on the project schedule due to delays in the review process, Accruent and Customer will work together to identify a revised timeline.

If an agreed-upon scope change occurs beyond activities contained in this SOW, any additional required funding must go through a change control process and approval. All changes will be agreed upon by both parties.

5. Terms for Termination: Besides statutory provisions in force, this Agreement may be terminated by either Party by written notice with immediate effect and without judicial intervention being required if the other Party applies for a moratorium on any payments, suspension of payments, or is declared bankrupt. 

In the event Accruent for any reason and at any time in its sole discretion decides to discontinue eLearning product development or training delivery, Accruent shall have the right to terminate this Agreement, with a prior 30 calendar days' written notice to the Company.

All training purchased as part of this agreement must be used within 12 months from the date of the Customer Purchase Order (CPO) or the date of signature of this SOW if a CPO is not applicable. Any training remaining after this period will expire and be unavailable to the Customer.
